Privacy Policy

 

User privacy and cyber security is a critical concern for all CarbonQuest, Inc. (“CarbonQuest”) products and services. We consider any energy resources as customer critical infrastructure. This means that, from our perspective, CarbonQuest’s role in the energy production, storage, monitoring, and control value stream is mission critical to our customers. This Statement of Privacy applies to verifyenergy.com, mypowerfly.com, and all other services and products provided by CarbonQuest, and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to CarbonQuest include verifyenergy.com, mypowerfly.com and services and products provided by CarbonQuest. By using the CarbonQuest website, or utilizing services or products provided by CarbonQuest, you consent to the data practices described in this statement. 
 
1.    Collection of your Personal Information. In order to better provide you with products and services offered, CarbonQuest may collect personally identifiable information, such as your: 
 
              a. First and Last Name 
              b. Mailing Address 
              c. E-mail Address 
              d. Phone Number 
 
CarbonQuest does not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services. These may include: (i) registering for an account; (ii) sending us an email message; (iii) signing up for our newsletter; or (iv) submitting your credit card or other payment information when ordering and purchasing products and services. CarbonQuest will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us and for Aggregated Statistics per Section 3. CarbonQuest also may gather information about you from other third parties.
 
2.    Use of your Personal Information. CarbonQuest collects and uses your personal information to operate and deliver the services and products you have requested. CarbonQuest may also use your personally identifiable information to inform you of other products or services available from CarbonQuest and its affiliates. 

3.    Aggregated Statistics. Aggregated Statistics means data and information related to your use of the services that is automatically generated by the normal operation of the services and used by CarbonQuest in an aggregate and anonymized manner, including to compile statistical and performance information related to the provision and operation of the services. CarbonQuest may monitor your use of the services, and collect and compile Aggregated Statistics based upon such use. As between CarbonQuest and you, all right, title, and interest in Aggregated Statistics, and all intellectual property rights therein, belong to and are retained solely by CarbonQuest. You acknowledge that CarbonQuest may compile Aggregated Statistics based on your personal information input into the services. You agree that CarbonQuest may (i) make Aggregated Statistics publicly available in compliance with applicable law, and (ii) use Aggregated Statistics to the extent and in the manner permitted under applicable law; provided that such Aggregated Statistics do not identify you or your confidential information. While CarbonQuest will do its best to delete your personal information from our records if requested, you understand that once your data is incorporated into our Aggregated Statistics model, it may be difficult or impossible to remove your data from that program. 
 
4.    Sharing Information with Third Parties. CarbonQuest does not sell, rent or lease its customer lists to third parties. CarbonQuest may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information is transferred to the third party. CarbonQuest may share data with third parties to help perform statistical analysis. 

CarbonQuest may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (i) conform to the edicts of the law or comply with legal process served on CarbonQuest or the site; (ii) protect and defend the rights or property of CarbonQuest; and/or (iii) act under exigent circumstances to protect the personal safety of users of CarbonQuest, or the public. 
    
5.    Tracking User Behavior. CarbonQuest may keep track of the websites and pages our users visit within CarbonQuest, in order to determine what CarbonQuest services are the most popular. This data is used to deliver customized content and advertising for customers whose behavior indicates that they are interested in a particular subject area. 
 
6.    Automatically Collected Information. Information about your computer hardware and software may be automatically collected by CarbonQuest. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the CarbonQuest website. 

7.    Use of Cookies. The CarbonQuest website may use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. 
 
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize CarbonQuest pages, or register with CarbonQuest site or services, a cookie helps CarbonQuest to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and more. When you return to the same CarbonQuest website, the information you previously provided can be retrieved, so you can easily use the CarbonQuest features that you customized. 
 
You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the CarbonQuest services or websites you visit. 

8.    Links. This website may contain links to other sites. Please be aware that CarbonQuest is not responsible for the content or privacy practices of such other sites. CarbonQuest encourages users to be aware when they leave CarbonQuest’s site and to read the privacy statements of any other site that collects personally identifiable information. 
 
9.    Security of your Personal Information. CarbonQuest secures your personal information from unauthorized access, use, or disclosure. CarbonQuest strives to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. All user communications with the system are encrypted using Transport Layer Security (TLS) protocol. When user data is transferred to be stored in the system, CarbonQuest applies encryption at rest by default (AES256 or AES128). All communications with CarbonQuest Cloud (built on the Google Cloud Platform) are encrypted using TLS (using root certificate authorities as required by standards). Each communication has a unique public/private key authenticated with JSON Web Tokens that are short-lived and are seamlessly reissued to prevent re-use if compromised. And since each device is unique, a compromised key would affect only a single device, not the entire fleet.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while CarbonQuest strives to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond CarbonQuest’s control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and CarbonQuest through this site cannot be guaranteed. 

10.    External Data Storage Sites. CarbonQuest may store your data on servers provided by third party hosting vendors with whom CarbonQuest has contracted. These include, but may not be limited to, CarbonQuest Cloud, which is built on the Google Cloud Platform.

11.    Right to Deletion. Subject to certain exceptions set out below, on receipt of a verifiable request from you, CarbonQuest will: i) Delete your personal information from CarbonQuest’s records; and ii) Direct any service providers to delete your personal information from their records. 
 
Please note that CarbonQuest may not be able to comply with requests to delete your personal information if it is necessary to: 


    a.   Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of the ongoing business relationship between you and CarbonQuest, or otherwise perform a contract between you and CarbonQuest; 
   b.    Continue functional operation of CarbonQuest’s Aggregated Statistics model;
   c.    Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity,  or prosecute those responsible for that activity; 
   d.    Debug to identify and repair errors that impair existing intended functionality; 
   e.    Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law; 
   f.    Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided CarbonQuest has obtained your informed consent; 
   g.    Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 
   h.    Comply with an existing legal obligation; or 
   i.    Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information. 

12.    Right to Non-Discrimination. Under the California Consumer Privacy Act (CCPA), you have a right to not receive discriminatory treatment by CarbonQuest from exercising any of your CCPA rights. These include your i) right to know about personal information CarbonQuest collects from you and how it is shared; ii) the right to delete personal information collected; iii) the right to opt-out of the sale or sharing of your personal information; iv) the right to correct inaccurate personal information; and v) the right to limit the use and disclosure of sensitive personal information.

13.    Children Under Thirteen. CarbonQuest does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website. 
        
14.    Changes to this Statement. CarbonQuest reserves the right to change this Privacy Policy from time to time. CarbonQuest will notify you about significant changes in the way CarbonQuest treats personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our website, and/or by updating any privacy information in this Privacy Policy. Your continued use of the website and/or services and products available after such modifications will constitute your: (i) acknowledgment of the modified Privacy Policy; and (ii) agreement to abide and be bound by that Policy.
